GENERAL TERMS AND CONDITIONS

of BICI Entertainment (Aquaparc commercial name).

 

These general terms and conditions (hereinafter known as “GTC” apply to:

 

The information contained in the Website or the brochure, as well as the GTC, is deemed pre-contractual information. 

No exemption from these GTC will be accepted without the prior written consent of the Seller. It is expressly specified that information contained in the brochure and/or on the Internet may be modified during the season.

ARTICLE 1 – Description of Services

1.1 The Seller invites Visitors (the Client and any accompanying persons) to spend a day at its water park, relaxing and enjoying the thrills and sensations of the water slides, a pirates’ ship, whirlpool baths and a Sharkyland area. These features are located in four different zones called Universe for the Family, Universe for the Little Ones, Sharkyland Universe and Sensation Universe.

The Seller declines responsibility for non-essential discrepancies between the photographs provided and the Services.

The list of Services is non-exhaustive and subject to change. The Seller is free to remove or modify the Services, or add new Services. The list of Services currently provided by the Seller, along with their prices and validity terms, are available on the Website and in the brochure.

ARTICLE 2 – Prices

2.1 All prices are indicated on the Website and at the Park entrance. Prices are expressed in Swiss Francs and include all taxes, based on tax rates applicable on the order date. They are subject to change after publication of the brochure and at any time during the Park’s opening season. Once the order is confirmed, the sale price is guaranteed.

2.2 Items included in the price of Services are set out in full in the relevant Website pages. Admission prices vary on the basis of different objective criteria. Price categories are as follows:

- One-day admission. Prices vary between adults, children, young children, students/teaching assistants, adults accompanying young children, and families (either 2 adults + 2 children, or 1 adult + 3 children).

- 4-hour admission. Prices vary between adults, children and young children.

- Late admission. Prices vary between adults, children and young children.

- Gift voucher

- Group rates available for groups of more than 20 people, with prior booking via the Website.

In addition, specific Services (birthday parties, comfort bonuses, etc.) are available at the prices indicated on the Website.

Admission tickets are valid for the date and duration indicated on the tickets.

A six-month pass is also available. (Advantages included with this pass are indicated on the Website.)

The car park is managed by the municipality of Port-Valais. Parking fees apply, payable at the parking ticket machines available on-site. Aquaparc declines all responsibility for incidents occurring on the car park.

ARTICLE 3 – Orders and Bookings

Admission tickets may be purchased on the Website, at the Park entrance or through authorised resale outlets.

The available Services can be booked and purchased on the Website or at the Park entrance.

All ticket purchases are irrevocable. Tickets cannot be exchanged or refunded, except in exceptional circumstances and only at the initiative of the Seller.

The Seller draws the Client’s attention to the fact that undated tickets do not guarantee admission to the Park when attendance levels are high.

Tickets are personal and non-transferable.

Order or Booking Confirmation

When an order is placed via the Website, the Client is requested to create an on-line Client account via a registration form, or to place the order as a guest. (It is compulsory to provide an email address to which the Park admission tickets can be sent.)

 The Client may at any time check the details and the total cost of their order. To finalise the order, the Client must read these GTC. The purchase of a ticket implies the Client’s agreement to these GTC, which apply to them.

ARTICLE 4 – Payment Terms

4.1 Accepted Payment Methods

The Seller accepts the following methods of payment:

 

 Payment for tickets must always be made in full before entry to the Park.

Any Services, food or drink purchased within the Park will be paid for at the exit.

ARTICLE 5 – Claims

Any claim relating to a disagreement about the execution of Services must be made in writing to the following email address:  contact@aquaparc.ch.

In any event, claims must be notified by the Client within fifteen (15) days of the end of the Service.

In order to avoid any discrepancy, proof of the visit (admission ticket, certificate, etc.) must be provided with the claim.

ARTICLE 6 – Liability

The Seller determines the Park’s opening days and times and decides which additional Services will be made available. The Seller may decide to close all or part of the Park to visitors and to stop all or part of the Services on offer, for whatever duration is deemed necessary, in particular for reasons relating to the health and safety of visitors, maintenance, repairs, rehabilitation or reorganisation of all or part of the Park installations, bad weather, public order, private booking of all or part of the Park, etc., without being held responsible and without the Client being able to claim compensation of any kind.

The Seller declines all responsibility for damages of any nature, including theft, damage and/or loss affecting visitors’ belongings, objects or equipment. Each visitor is responsible for any direct or indirect damage they may cause during their presence at the Park.

The Client undertakes to observe, and ensure their accompanying persons observe, the Park regulations and all safety rules displayed at the Park. The Seller declines responsibility for any damage caused by non-observance of safety rules by the Client or by any visitor present at the Park.

The Seller’s competent services are authorised to proceed with the expulsion of offenders, who will have no means of recourse. Expelled visitors may under no circumstances obtain refunds for their admission tickets.

Case of force majeure - The Seller declines all responsibility for their non-observance of obligations due to a fortuitous event, a case of force majeure, or a situation caused by a person unknown to the Seller, for example (non-exhaustive list): strike action, fire, flooding, blocked access, weather conditions, epidemics, decisions taken by the authorities, etc. This clause covers all situations beyond the control of the Seller or any service provider involved in the Service execution, and of which the consequences are unavoidable even when all reasonable measures have been taken, and which prevent the fulfilment of all or part of the obligations set out in the contract.

ARTICLE 7 - Personal Data

In compliance with the GDPR, applicable in Switzerland since 1 September 2023, we inform our Clients that their personal data will be digitally processed by the Park Management for the purposes of customer relations: answering queries, sending newsletters and providing any other information about our company and/or Services. Data is handled by the Park Management and its authorised personnel whose role requires access thereto, including the sales and accounts departments, as well as subcontractors under strict instructions from the Park Management.

Clients’ personal data is kept no longer than is deemed necessary for the purposes for which such data is processed, and in any case, no longer than two (2) years after our last unanswered communication with the Client, unless the Client requests deletion or opposes the use of their data in the meantime.

Clients can, at any time, exercise their right to rectify, delete, oppose, limit the use and transfer of their data at the following address: Bici Entertainment SA, Route de la Plage, 122, 1897 Le Bouveret - Switzerland and contact@aquaparc.ch The Client will receive a response within one (1) month.

The Park Management takes responsibility for the protection of its Clients’ personal data and implements measures to ensure their security, integrity and confidentiality. For more information about the Park’s personal data protection policy, Clients are invited to read the personal data protection charter provided on the Park Website.

All personal data shall remain confidential. Only the data required by the sales procedure will be held.

ARTICLE 8 – Applicable Law

The interpretation and implementation of these GTC are governed by Swiss law.

ARTICLE 9 – Settlement of Disputes

For any dispute arising between the parties, priority must be given to an amicable settlement.

After sending a claim to the Seller by the method set out in Article 5 above, the Client may, in the absence of a satisfactory response from the Seller and if no mutual agreement is reached, refer the matter to the competent court.
The competent jurisdiction will be determined by the location of the Park address.
